SERVICE AGREEMENT FOR “DIGITIZE YOUR ART” COURSE

1. Introduction
   This Service Agreement (the “Agreement”) outlines the terms and conditions (“Terms”) governing your purchase and participation in the “Digitize Your Art” course (the “Course”) provided by Indy Bloom Design (“Company,” “we,” or “us”). By purchasing and participating in this Course, you (“Customer,” “you,” or “your”) agree to be bound by these Terms.

2. Course Access and Requirements
   2.1 Access & Hosting: Upon purchasing the Course, you will receive access to the online course materials through Kajabi. You may also download the Kajabi app for on-the-go viewing.
   2.2 Equipment and Software: You acknowledge that it is your responsibility to have the necessary tools and equipment to fully participate in the Course. Specifically, a working computer and a licensed copy of Adobe Photoshop  are required.
   2.3 Updates: The Company reserves the right to update or modify the Course materials at any time, without prior notice, to enhance the user experience or ensure the most current content is available.

3. Refund Policy
   3.1 Refund Period: You are eligible for a refund if you request it within seven (7) business days from the purchase date of the Course.
   3.2 Proof of Purchase: To request a refund, you must provide a valid receipt of purchase as proof of the transaction.
   3.3 No Refunds After 7 Days: After seven (7) business days from the date of purchase, no refunds will be issued under any circumstances. No exceptions.
   3.4 How to Request a Refund: Please email your refund request and proof of purchase to [email protected] within the specified refund period.

4. Results Disclaimer
   4.1 Individual Results May Vary: We do not guarantee that your results will be identical to Mindy’s or any other individual’s. Success in this Course depends on various factors, including your personal commitment, existing skills, and the effort you apply in implementing the strategies and tools taught.
   4.2 Customer Responsibility: We provide the tools, resources, and training necessary to help you succeed. However, your success depends solely on your effort, skill, and dedication.

5. Copyright and Intellectual Property
   5.1 Ownership: All Course materials, including but not limited to video lessons, written materials, graphics, and other content, are the exclusive property of Indy Bloom Design and are protected by copyright and other intellectual property laws.
   5.2 Restrictions: You may not copy, share, reproduce, distribute, modify, or create derivative works of the Course materials without our express written consent. Unauthorized use or distribution of any Course material is strictly prohibited and may result in legal action.
   5.3 License: Your purchase grants you a single-user license to access and use the Course materials for your personal, non-commercial use only.

6. Compliance and Right to Refuse Service
   6.1 Compliance With Terms: You agree to comply with all terms and conditions set forth in this Agreement.
   6.2 Right to Refuse: We reserve the right to refuse or revoke access to any Customer who fails to comply with these Terms. In such cases, no refund will be issued.

7. Limitation of Liability
   7.1 No Warranties: The Course is provided “as is” without any representations or warranties, express or implied.
   7.2 Limitation of Damages: To the maximum extent permitted by law, in no event shall we be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of your use or inability to use the Course materials.

8. Indemnification
   You agree to indemnify and hold harmless Indy Bloom Design, its affiliates, employees, and contractors from and against any claims, damages, liabilities, costs, and expenses arising out of or related to your breach of this Agreement or improper use of the Course materials.

9. Governing Law and Dispute Resolution
   This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is located, without regard to its conflict of law provisions. Any dispute arising from or relating to this Agreement or the Course shall be resolved through good-faith negotiations. If a resolution cannot be reached, the dispute shall be settled by a court of competent jurisdiction within the Company’s location.

10. Data Privacy
    10.1 Use of Information: We respect your privacy. We do not share or sell your personal information to third parties. We only store your information for Course-related communications, such as sending updates, notifications, and important announcements.
    10.2 Contact Preferences: By enrolling in the Course, you consent to receive periodic emails regarding Course updates, promotional offers, and other relevant information. 11. Entire Agreement
    This Agreement constitutes the entire understanding between you and Indy Bloom Design with respect to the subject matter herein and supersedes all prior or contemporaneous agreements, representations, and understandings, whether written or oral.

12. Amendments
    We reserve the right to modify or update this Agreement at any time. Any changes will be effective immediately upon posting the revised Agreement, and your continued use of the Course after such posting constitutes your acceptance of the modified Agreement.
